Mission Viejo City Council votes to support the U.S. Constitution, State Constitution and traditional ‘Rule of Law’

The Mission Viejo City Council on Tuesday unanimously approved two actions in support of local control of public safety. The Council joined the amicus brief that supports the federal government’s contention that federal law preempts contrary state laws and adopted a resolution in support of the Los Alamitos City Council’s bid to opt out of the California law which prohibits local law enforcement from full cooperation with lawful federal authority. 
 
The Council voted to support the ordinance approved in Los Alamitos earlier this month which asserts laws that are inconsistent with controlling federal laws should not apply to California cities. The Council ordered the City to join in the amicus brief supporting a federal lawsuit filed against certain recently adopted California laws. The lawsuit addresses parts of three California laws that are intended to establish procedures that appear preempted by federal law.
 
The California Values Act prohibits local law enforcement officials throughout the state from asking about immigration status. It also bars local authorities from holding undocumented immigrants in jails until federal authorities can pick them up and regulates the businesses for cooperating with federal officials.
 
The Mission Viejo City Council believes this legislation is a threat to both local control of businesses in the state and the individual liberty and public safety because it prevents law enforcement from performing their duties as necessitated by local circumstances.

Well done City Council! Your action is in direct line with NATIONAL law. The key word here is: ILLEGAL! California already has the highest ILLEGAL population in the nation. There are ways to enter this country legally. It has been done by millions of Americans who respect our culture, religion, and our flag. Why should these ILLEGALS suck the coffers of California dry because some politicians think that anyone who ever crosses our borders get the "Golden Ticket", all kinds of "stuff" that the other citizens of California pay for with one of the most precious things they have. MONEY, in all forms of taxes and fees. I FULLY support you in approving this measure.

Thank you for taking the time to post your comments against action taken by the City Council. I feel very much as you do that the process of protection for individuals should not be taken lightly and with so little concern for our mutual interests. Very worrying.

I stand with you and hopfully more concerned citizens wondering who will stand by the concept of due process.

I could not disagree more with this action. California law is the will of the majority of people in California, and it applies to ALL of California. It is not the business of our police force to aid the federal government in identifying or detaining immegrants.

The bottom line is that Federal Laws supersedes State laws...
California Sanctuary Laws are ridiculous and only contribute to the violation of Federal laws. Mission Viejo is an outstanding city and a big part of that is related to the security that the City provides with great Police and Fire Services. Working outside of the City for many decades, I have seen the results of uncontrolled immigration and both the positive and negative that come with it. We absolutely must enforce the laws in order to maintain and enjoy our high standard of living. Federal immigration law enforcement becomes especially important when dealing with illegal immigrants who are arrested for additional crimes!!!
The citizens of Mission Viejo are extremely fortunate to have political leaders who are willing to voice their opinions and to take a stand against these Sanctuary Laws.

We thoroughly enjoy living in Mission Viejo. However, we think the recent City Council's decision to be complicit with the federal government in diverting local law enforcement into aiding ICE's efforts to round up illegal immigrants is totally wrongheaded. Please ask next time when you put my city on the line actively supporting immoral federal activities.

So...’States Rights’ are out, but Federal decree and local government control are in.
Honestly, practically, how is Mission Viejo involved with this policy? Is there a jail facility currently within the city limits that will now start holding inmates for the Feds? I thought the City’s Police are Orange County Sheriff’s Deputies anyway, and so if anything this is strictly a County-level issue for the City of Mission Viejo??

I am very sorry to read all the comments that slam the Council for the action they took. Folks this is not about immigration : this is about upholding the law of the land. Think about it this way: you and I as drivers are expected to obey the laws. When we disobey the law, we get tickets or get hauled into jail. We cannot make our own laws about driving, they already exist and we are expected to obey them. The City Of Mission Viejo just did the same thing-they said we intend to uphold the laws of the land. What the state of California is doing by calling itself a sanctuary state is taking a cafeteria plan as it pertains to deciding what federal laws it intends to obey. This is not a good thing for the citizens of this state! This is not how government works. Be thankful we live in a city that respects the laws and is dedicated to providing safety for its citizens.

I am appalled that our City Council would take it upon themselves to speak for all of us when they have no idea how we feel about such a critical topic. I am saddened by the stance taken by our City Council. It looks like five white people decided to allow people from other cultures who are living peacefully amongst us and contributing to our culture and economy to be treated without dignity and due process. It's a sad community that doesn't care about their neighbors and friends and only for what they themselves need and want. You should be ashamed of yourselves. The immigrants living amongst us are not criminals or terrorists. White radical males are the typical threat in our society. Not to worry...I intend to campaign heartily to have our City Council overturned in the next election.

Based on the outcome of growing political groups in this city who don’t support this action,this council is out of step with our values. We need to correct this in the next elections.

I disagree completely with this decision by the city council. A decision of this magnitude should reflect the values of the people in an election. Mission Viejo is part of California, and should abide by state laws. I am ashamed of this decision by my home city.

The thing with these disparity in laws is it just shifts the population around.

neighboring sanctuary cities end up taking the new immigrant population. Would be interesting to do a study on low income housing rent increase/decrease versus sanctuary city status fluctuations.
