APPLICANT AGREES TO ABIDE BY ALL CITY POLICIES, EXHIBITION PROCEDURES
Release, Hold Harmless, and Agreement Not to Sue
I, the undersigned, do fully understand that my and/or my organization’s participation in the Arts Exhibit (herein ‘Event’) may present risk of personal injury, death, communicable diseases, illnesses, viruses, and/or property damage or loss. I hereby acknowledge that I and/or my organization am/are voluntarily participating in this Event and agree to assume any risks. I and my organization further agree to conform to all the rules and regulations.
I hereby release, indemnify, hold harmless, and agree not to sue the City of Mission Viejo and its officers, officials, employees, agents, representatives and volunteers for any injury, death or damage to or loss of personal property arising out of, or in connection with, my/my organization’s participation in the Event from whatever cause, including the active or passive negligence of the City of Mission Viejo or any other participants/patrons. The parties to this AGREEMENT understand that this document is not intended to release any party from any act or omission of “gross negligence,” as that term is used in applicable case law and/or statutory provision.
In consideration for being permitted to participate in the Event, I hereby agree, for myself, my heirs, administrators, executors, and assigns, that I shall indemnify and hold harmless the City of Mission Viejo and its officers, officials, employees, agents, and volunteers from any and all claims, demands actions or suits arising out of or in connection with my and/or my organization’s participation in the Event.
I hereby irrevocably give consent to the City of Mission Viejo and its officers, employees, officials, agents, and representatives, for valuable consideration received, to use, authorize and assign un-limited permission to use, publish and republish for any purpose whatsoever, by the City of Mission Viejo or anyone authorized by the City of Mission Viejo, any and all video and/or photographs which you have taken of me and/or the Exhibit, negative or positive, without further compensation to me. All video and photographs, including negatives and positives, together with the prints shall constitute the property of the City of Mission Viejo.
 
I have carefully read this release, hold harmless and agree not to sue and fully understand its contents. I am aware that it is a full release of all liability and sign it of my own free will.
